As the new regulation came into effect on 6th April 2020, we are sending the Key Information Document (KID) template to all agencies that we work with.
It must be the first document that is agreed between an employment business with any new work-seekers registering on or after 6 April 2020 – and before the employment business and work-seeker agree to any terms and conditions (as required by regulation 14 and 15 of the Conduct Regulations). Terms under regulations 14 and 15 must be agreed upon before any work-finding services are provided by the employment business to the work-seeker.
Where an intermediary or umbrella company involved in the payment of wages to a work-seeker supplied to a hirer by an employment business the KID must be issued by the employment business to both the intermediary or umbrella company and to the individual agency worker who is supplied to carry out the work. Each KID needs to be work-seeker (contractor) specific.
The Employment Agency Standards (EAS) inspectorate is responsible for the rights of the agency workers and will enforce the new requirement. EAS can be contacted at EAS@beis.gov.uk.
It is also worth noting that a new KID will also need to be issued when the details within them change; such as the change in pay frequency, introduction of a deduction, or a change in intermediary or umbrella company.
We are including a prepopulated KID along with our compliance pack so that any agency will receive this automatically when we send over any new starters.
Internally we have updated our system so that, from 6th April 2020 onwards, where we are not in possession of a KID from an agency for an agency worker, we are unable to process payment. This must be received prior to any payment being made.
